Spill reporting and registration, storage, and planning requirements
New Edwards Aquifer Authority regulations became effective on March 21, 2008 for spill reporting and for registration, storage and planning requirements of certain facilities storing regulated substances. The rules consist of Edwards Aquifer Authority Rules, ch. 713 (Water Quality), subchs. E (Spill Reporting) and F (Hazardous Substances Registration, Storage, and Planning). All Authority rules can viewed on the Authority’s web page under “Rules.”
Subchapters E and F apply to spills and facilities if the location meets the following criteria:
· Within the Edwards Aquifer Recharge Zone or Edwards Aquifer Contributing Zone within five miles of the recharge zone; and
· Within the Authority’s boundaries in Uvalde, Medina, Bexar, Comal, or Hays counties; and
· Within the Authority’s 5-mile water quality buffer zone which extends outside the Authority’s boundaries.
Subchapter F (Hazardous Substances Registration, Storage, and Planning) relates to the following facilities:
· Facilities storing more than 1,000 gallons or 10,000 pounds of a regulated substance; and
· Facilities storing the quantity threshold in containers that are 55-gallons or less.
Facilities regulated by Subchapter F must register with the Authority, comply with the secondary containment requirements, and prepare a Spill Prevention and Response Plan (SPRP) as indicated in the rules. Regulated facilities existing upon the effective date of the rules (March 21, 2008) are required to implement the requirements of Subchapter F within 180 days (by September 17, 2008). Facilities constructed after the effective date of the rules must implement the requirements of Subchapter F within 180 days after commencement of operations

Annual Groundwater Conservation Plan Status Reports
All persons required by § 715.106 (Duty to Prepare and Implement Groundwater Conservation Plan) of the Edwards Aquifer Authority Rules, shall file with the Authority an annual groundwater conservation plan status report no later than 4:30 p.m. on the following dates:
Municipal users March 31st of each year
Industrial users June 30th of each year
Irrigation users September 30th of each year

Permit Transfers
New well owners may not qualify or exempt wells and existing well owners may not have a sufficient groundwater withdrawal permit to meet their needs. These well owners may obtain all or part of a regular permit from another permitted well owner through a transfer. All municipal, industrial and irrigation well owners are required to file transfers when they change the ownership, place of use, purpose of use or point of withdrawal for their groundwater withdrawal permit. Please note that not all people doing transfers will need the memorandum of lease. It is only used for those people that want to lease water rather than buy.

Well Construction Forms
A properly constructed well can prevent groundwater contamination and protect the health of the well user. As a method of managing water quality and quantity in the Edwards Aquifer, the Authority requires that a permit be obtained for all new well construction or major modifications to existing wells that withdraw groundwater from or pass through the Edwards Aquifer.

Storage Tank Registration Form
The Edwards Aquifer Authority, in an effort to protect and preserve the region’s primary groundwater supply, regulates aboveground storage tanks (ASTs) and underground storage tanks (USTs) located on or in close proximity to the Edwards Aquifer recharge zone as a means of preventing the release of potentially harmful substances into the aquifer.
On July 12, 2008, the Edwards Aquifer Authority (Authority) Board of Directors adopted rules which require registration of aboveground and underground storage tanks containing regulated substances located in, above, or on the Recharge Zone of the Edwards Aquifer. These rules became effective on July 18, 2008. The rule regarding tank registration can be found in the Edwards Aquifer Authority Rules, ch. 713 (Water Quality), subchs. G (Aboveground and Underground Storage Tanks), § 713.611.
Pursuant to this rule, storage tanks meeting the following criteria must be registered with the Authority within 180 days of the effective date of the rule. Specifically, existing or proposed storage tanks must be registered with the Authority if:
· Constructed in, above, or on the Edwards Aquifer Recharge Zone within the Authority’s jurisdictional area or within five miles upgradient from the recharge zone within and beyond the Authority’s jurisdictional boundary;
· Have a capacity greater than 110 gallons of a regulated substance; or greater than 600 gallons if used to store motor fuel.
This rule does not apply to sealed containers less than 56 gallons in size that are stored for resale. Additional exemptions are detailed in Chapter 713, subchs. G, § 713.607-Exemptions.
